Limitations of Liability Our total liability with regards to the contract governed by these terms and conditions will be limited to the value of the goods. Living It Up shall not be liable for any direct, indirect or consequential losses incurred as a result of the terms agreed in this contract.
Any order accepted by Living It Up is subject to the terms and conditions specified in this contract unless otherwise stipulated in writing by Living It Up.
Living It Up reserves the right to refuse any order which is subject to errors in pricing or where it is no longer possible to supply a particular product for some reason.

Description of Goods It is the responsibility of the customer to check that their order is confirmed correctly. Dimensions of all products are available on the Living It Up website and the customer should satisfy themselves the goods will fit into their property as intended.
Products pictured on the website may be photographed with other items which are not included in the product description. Photographs are for illustrative purposes only.

Payment and Delivery Payment for orders is processed immediately when the order is received by Living It Up unless there are any unresolved issues with stock availability. In the event that Living It Up cannot meet the order requirements then the customer will be informed within 48 hours of the order being received. Once payment is processed then a contract exists between Living It Up and the customer and that contract is governed by these terms and conditions.
All product prices exclude VAT at the prevailing rate.
Delivery to the UK Mainland is usually possible within 5 days of the order being received, provided the item is not a custom order. Delivery is usually possible to the British Isles (i.e. excluding the Mainland) but a delivery quote must be obtained prior to the order being accepted. Any extra charges incurred will be passed on the customer. Delivery will either be carried out by a contracted third-party courier or by Living It Up’s own delivery operative.
Living It Up does not undertake delivery outside of the British Isles but may accept orders if the customer is willing to arrange their own transportation.
Risk for the goods passes to the customer upon delivery. Regardless of delivery status ownership of the goods will pass when payment has been received.
The customer should check their delivery thoroughly on receiving the goods. If the delivery is checked and any damage is found this should be clearly noted on the proof of delivery. If the customer is unable to check the goods then they should be signed for as unchecked.

Backorders and Reservation of Stock “Pre-order” is the reservation of stock on backorder with our supplier. A “reservation” is to order an item currently in stock with Living It Up when immediate delivery is not required. Items can be pre-ordered or reserved; a 30% deposit will be required for the order to be processed.
Reserved stock will be held for up to 8 weeks, pre-ordered items will be held for up to 8 weeks after arriving in to stock. The 30% deposit paid is refundable for up to 3 weeks after the item has arrived in to stock (or 3 weeks after the order is placed for reservations). After this 3 week period the deposit is then non-refundable. After 8 weeks of the item being held in stock the order will be cancelled if delivery has not already been arranged. | Fraudulent Orders Living It Up will take all steps which are necessary and practicable to ensure that any orders received which appear to be fraudulent are fully investigated before any goods are despatched or any payment is taken. This is for the protection of our customers. Where the delivery address differs from the registered card address we may send out a confirmation letter to establish that the order is genuine.

Guarantees & Right To Return Any defects or damages to goods should be reported to Living It Up in writing within 7 days of receiving the goods. Letters address to: Unit 1, 5 Knights Close, Thurmaston, LE4 8EW; or email info@livingitup.co.uk
Living It Up goods are guaranteed against defects in materials or faulty workmanship for 12 months from the time they are delivered. In the event that any goods are found to be defective within the guarantee period, or if goods are damaged in transit, then Living It Up will cover any costs incurred as a result of the need to exchange goods including transportation costs.
The customer has the right to return goods to Living It Up within 7-days of the delivery taking place provided the goods are kept in original condition and with their original packaging. Partially or fully constructed furniture cannot be accepted for return in any circumstance. This does not apply to custom made orders.
If the customer decides to return the goods within this 7-day cooling-off period then Living It Up will charge collection at a rate equivalent to the original delivery charge. The original delivery charge is also non-refundable and these transport costs will be deducted from the refund amount. Any extra charges incurred due to the goods not being available for collection at the agreed time will also be charged to the customer. This does not apply to custom made orders.
The customer may choose to return the goods via their own means of transportation in which case they are responsible for arranging the transport and for any damages occurring in return transit.
Subsequent to the goods being returned, Living It Up will inspect the goods to establish that they are still in their original condition. Should any damage be found to the goods then Living It Up reserve the right to recover a reasonable amount from the refund value of the goods to cover said damage. No refund will be made prior to inspection of the goods.
Refunds can only be processed to the original credit or debit card used at the time of purchase.

Credit Card Security When your order is placed at our website you will be redirected to a secure hosting (EPDQ) server for payment. Here, your credit card numbers will be encrypted using 128 bit encryption. They are not held in clear text on any web site at any time.

Privacy Policy Living It Up do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
